Approval of the September 11, 2006, Zoning Meeting Minutes (detailed minutes to replace Council Brief minutes adopted on September 18, 2006), and approval of the October 2, 2006, Council Brief minutes. Administration and Finance

Councilwoman Winiski moved approval of the Consent Agenda. Councilman Orlans seconded and the motion passed 3-0.

Rezoning & Intent to Annex

  1. RZ06-25, King's Grant, King Rd & Kent Rd., FC-A (Fulton County Annexed), Land Lots: 1233, 1234

Staff requested a deferral to the Oct. 16, 2006, City Council meeting.

  1. RZ06-26, Wynfield Estates, Etris Rd. & Wynfield Estates Dr., FC-A (Fulton County Annexed), Land Lots: 1163, 1164

Staff requested a deferral to the Oct. 16, 2006, City Council meeting

  1. RZ06-27, Old Surrey Place, Cox Rd. & Old Surrey Place, FC-A (Fulton County Annexed), Land Lots: 1092, 1143, 1144, 1145, 1160, 1161

Staff requested a deferral to the Oct. 16, 2006, City Council meeting.

Councilman Orlans moved to defer items 1, 2 and 3 to the October 16, 2006, Council Meeting. Councilwoman Henry seconded and the motion passed 3-0.

 

Rezoning & Conditional Uses

  1. CU06-03, 407 Hardscrabble Rd, Jacob's Ladder/Cornerstone Craftsmen, Inc., E-2 (Single-Family Estate Residential District) to Conditional Use, private school.

* The applicant requested a conditional use of the property to allow for an existing single-family home to be converted into a learning facility for children.

* The property is located at 407 Hardscrabble Road and is currently zoned Single Family Residential.

* The existing home on the site is 3,019 square feet and the applicant plans on a future 2,000 square foot addition to be used as a learning facility.

* The Planning Commission recommended approval with conditions at its Sept. 19, 2006 meeting.

* Public comment heard.

Councilman Orlans moved to defer the item for further staff review to the October 16, 2006, Council meeting. Councilwoman Winiski seconded and the motion passed 3-0.

5. RZ06-15, Fred Shayegh, 9755 Hightower Rd., E-2 (Single-Family Estate Residential District) & R-1 (Single-Family Residential District) to R-1 (Single-Family Residential District), Land Lot: 300 (deferred from August 14, 2006 Mayor and Council Meeting)

* The applicant requested a rezoning for a single family subdivision located on Hightower Road.

* The site plan calls for building 11 homes on 7.26 acres.

* The Planning Commission recommended approval during its July hearing.

* Public comment heard.

Councilman Orlans moved approval with conditions. Councilwoman Winiski made a substitute motion to defer the item to the October 16, 2006, meeting with a recommendation that the applicant achieve the site line of the road to be 35 feet from the abutting property. Councilwoman Henry seconded and the motion passed 2-1 with Councilwoman Winiski and Henry voting for the motion and Councilman Orlans voting against the motion.

 

6. RZ06-19, 11450 Alpharetta Highway, J. M. Dixon/Carmax Auto Superstores, Inc, Land Lots: 517, 518, 547, 548, C-3c (Highway Commercial District) conditional to C-3 (Highway Commercial District), Automobile sales/service

* The rezoning is a site plan change from a previous from a previously approved rezoning, RZ83-60.

* The applicant is asking to remove two buildings from the previous site plan and use the property as a car sales business.

* The applicant is also requesting a variance to the City's lighting ordinance.

* The Planning Commission recommended approval of the rezoning but denial of the variance request.

* Public comment heard.

Councilman Orlans moved approval with conditions. Councilwoman Henry seconded the motion. Councilwoman Winiski made an amendment to the motion to prohibit unloading cars on Alpharetta Highway. Councilwoman Henry seconded the amendment and the motion passed 3-0.

7. CU06-02, 10465 Woodstock Road, Hockman, R-1 (Single-Family Residential) to Conditional Use, Land Lot: 370, In-law suite addition.

* The applicant is requesting approval to build an in-law apartment above a proposed attached garage.

* The Planning Commission recommended approval subject to the in-law apartment being occupied by immediate family members of those who live in the main house.

* Public comment invited.

Councilman Orlans moved approval with conditions. Councilwoman Winiski seconded the motion and it passed 3-0.

 

Parkway Village

  1. PVVR06-01 and SBP06-05, East Crossville Rd., Johnson/Willis LLC, Parkway Village Request, Land Lot: 430, townhomes.

* The applicant is requesting to build a 34-unit townhome development within Parkway Village.

* The applicant is requesting two variances to the Parkway Village requirements: 1) A reduction of the buffer from 40 feet to 20 feet on the west side property line and a reduction in the building setback from 30 feet to 15 feet. 2) A reduction in the building setback along the eastern property line from 30 feet to 20 feet.

* The applicant is also requesting a variance to the stream buffer requirements.

* The Community Development Department recommends approval of the two Parkway Village variances but denial of the stream buffer variance.

* Public comment invited.

Councilman Orlans moved approval with conditions and denial of the variances. Councilwoman Winiski seconded and the motion passed 3-0.

Text Amendment

9. RZ06-21 Text Amendment to the Roswell Zoning Ordinance regarding the additional screening requirements for recreational vehicles/other located on corner lots.

(1st Reading)

* The City Attorney David Davidson read the amendment.

* The text amendment would require additional screening of recreation vehicles, boats, campers, etc. that are parked on a corner lot.

* Public comment invited.

Councilman Orlans moved approval of the text amendment. Councilwoman Henry seconded and the motion passed 3-0.

River Corridor

10. RC05-06R, To consider issuing a Certificate for the construction of an in ground pool to be located 510 Riverside Road, Land Lot: 459

* The applicant is seeking approval to build an in-ground swimming pool at 510 Riverside Road.

* The Atlanta Regional Commission has found the proposal to be consistent with the Chattahoochee Corridor Plan.

* The Community Development Department recommended approval.

* Public comment invited.

Councilman Orlans moved approval. Councilwoman Henry seconded and the motion passed 3-0.

Other

11. Approval of a Resolution to adopt the Annual Update to the Short Term Work Program (STWP), the Capital Improvement Element (CIE) and related amendments to the 2025 Comprehensive Plan and the Future Land Use Map.

* The Mayor and City Council approved the Annual Update to the STWP, CIE and related amendments to the 2025 Comprehensive Plan and Future Land Use Map at their July 10, 2006 meeting.

* The last step in this process is the approval of the resolution.

* Public comment invited.

Councilman Orlans moved approval. Councilwoman Winiski seconded and the motion passed 3-0.

12. Approval of a resolution to authorize the submission of a grant application for the "Campaign to Preserve Georgia's Historic Cemeteries" Grant Program offered through the Historic Preservation Division of the State Department of Natural Resources.

* The purpose of the grant is to assist local communities in promoting their cemeteries through heritage tourism.

* Roswell is one of 13 Preserve America Communities in Georgia that has received an invitation to apply for the grant.

* The Historic Preservation Commission and the Historical Society fully support the project.

* The Community Development Committee recommended approval at its Sept. 8, 2006 meeting.

* Public comment invited.

Councilman Orlans moved approval. Councilwoman Winiski seconded and the motion passed 3-0.
