The City of Johns Creek is currently in a legal transition from Fulton County to City of Johns Creek authority.
Therefore, with respect to the Nov. 29 opening of the Love Shack – an adult bookstore at 10950-A State Bridge Road in Johns Creek – Fulton County still holds jurisdiction over this matter.
“Though we’re currently constrained by transition components of our charter, we’ll move quickly to ensure legal compliance with all components of the law and our City stands ready to participate and defend our community’s standards as soon as we’re legally allowed,” said Johns Creek Mayor Mike Bodker.
On Nov. 30 Fulton County Superior Court dismissed a request by the Fulton County Attorney’s Office for a temporary restraining order, which could have effectively shuttered the doors of the Love Shack until such time as the Federal dispute over their legal status to operate at the current location is settled in court.
Simultaneously, the Fulton County Attorney’s Office filed a contempt petition in U.S. District Court against the Love Shack. A hearing on that contempt petition is still pending.
“While we can never predict the outcome of a pending legal action we agree
strongly with the position that Fulton County is taking on behalf of our citizens and we are confident that the courts will do the right thing,” said Bodker.
